1. Visualised digital creative competition (“Competition”) is open to individuals who are members of the Australian Interactive Media Industry Association (AIMIA)
2. Employees of Getty Images and each of its agents, employees and anyone connected with the due administration of the Competition or related to such individuals immediate family members (spouse, parent, child, sibling and their respective spouses) are not eligible to participate in the Competition.
1. To take part in the Competition you must enter before the 29th February 2012 at 11:59pm AEST (such end date may be subject to change without notice):
2. At least 50% of the images and video used in your Entry must be from gettyimages.com (the “Getty Images’ Website”). All music must be from the artist osh10 on the Getty Images Music collection. Audio, video and still material from other sources are not allowed unless they are your own original, creative material.
3. If you create a video it should be 1-3 minutes long (maximum 3 minutes), details on how to upload your entry will be emailed to you after you have registered at www.gettyimages.com.au/visualised.
4. Entry is free, maximum two Entries per person.
5. If your Entry includes any elements not taken from the Getty Images’ Website, you must make sure that the use of such elements will not infringe any copyright or any other intellectual property rights. Entries must not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or property rights.
6. You may download any hi-resolution still images, video clips and music from the Getty Images’ Website for use in the submission without charge or purchase of any kind for the purpose of entering the Competition only as set out on the How to enter page. Entrants acknowledge that they will not have access to all Getty Images’ Website collections for the purposes of this Competition, however all entrants will have equal access to the same collections.
1. The promoter is Getty Images DevCo Australia Pty Ltd with offices at Level 6, 182 Blues Point Road, McMahons Point NSW 2060. All decisions made by the judges or Getty Images in all matters regarding this Competition are final.
2. The winner of the Competition is decided entirely on merit and there is no element of chance involved. The criteria used by the judges to select the winners shall be relevant to the brief available at www.gettyimages.com.au/visualised
3. Prize: The winner of Visualised will receive a Mac Book Air 13 inch: 256GB valued at $1799 AUD plus Adobe Creative Suite software valued at $4344 AUD
4. Judging: The committee for the 2012 AIMIA awards will be the judging panel for the competition.
5. The winner will announced at the 2012 AIMIA awards to be held on 13 March 2012 at Cockatoo Island, Sydney Australia.
6. No transfer, assignment or substitution of prize except by Getty Images who may substitute prize with one of comparable or greater value, at its sole discretion.
7. All entrants are eligible to win one prize only.
8. In the event an entrant is not deemed eligible to receive a prize, an alternative winner shall be selected by the judges.
1. All rights in any content selected from the Getty Images’ Website remains vested in Getty Images and its licensors.
2. Entrants may not use any content obtained from the Getty Images’ Website for any other purpose than their participation in the Competition and must destroy all copies of such content immediately after their participation to the Competition. Any other use of still images, video clips and music from the Getty Images Website requires a license.
3. Entrants are allowed to keep a copy of their submission in their portfolio.
4. Getty Images will not be liable for any damage, loss or disappointment suffered by any person taking part or not being able to take part in the Competition.
5. Getty Images may reject any submissions it considers in its sole discretion to be immoral, obscene, profane or in violation of these rules.
6. Use of a false name or address will disqualify an entrant. Getty Images reserves the right to oblige any potential winner to provide documentary proof of their identity.
7. By entering, each entrant warrants and represents (in other words promises) that his/her Entry does not defame or otherwise violate the rights or any third party and does not violate any laws or regulations of the territory in which they reside. Entrants further warrant and represent that they have secured the requisite consent from any third party referenced or pictured in their Entry (including but not limited to video, audio, still, any company or other third party trademarks or logos) and if requested by Getty Images, agree to provide legal release for the use of such reference in a form satisfactory to Getty Images.
8. By taking part of this Competition, you grant Getty Images and the contributing music artist, Osh10, a worldwide, royalty free, perpetual license to publish and reproduce your Entry in its trade, advertising or promotional material in any media without further consideration, notification or permission to entrant or any third parties. For these purposes, entrants waive all moral rights they would otherwise have had under applicable laws to either object to modification of their work or require that their name appear in conjunction with any released work. To the extent such waivers are not permitted by applicable law, you agree not to enforce such moral rights against Getty Images.
9. Entrants agree that Getty Images shall have no liability and will be held harmless for any liability, loss, injury or damage, due in whole or in part, directly or indirectly, by reason of winner’s acceptance, possession, use or misuse of any prizes. Getty Images is not responsible for any inability of any winner to accept a prize.
10. The winners of the Competition are solely responsible for any and all taxes associated with the prizes awarded.
11. Getty Images is entitled to modify the rules to enter into the Competition at any time without notice.
12. Getty Images and the entrants shall be entitled to embed the Entries on other websites of its choice.
